Terms of Use

These Terms of Use ("Terms") govern your access to and use of followtheduck (followtheduck.app), operated by OKQ (BE0677.687.629), Rue Louise Colen 10, 5004 Bouge, Belgium, Belgium. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use followtheduck.

followtheduck lets waitlist owners create hosted signup pages and embeddable widgets to collect subscriber emails, manage waitlists, and export subscriber data subject to plan limits. We may modify, suspend, or discontinue features with reasonable notice where practicable.

You must be at least 16 years old and able to form a binding contract. You sign in via magic link sent to your email — you are responsible for securing access to that inbox. You must provide accurate information and keep your account credentials secure. One person or legal entity per account unless we agree otherwise in writing.

As a waitlist owner, you are the data controller for subscriber emails you collect. You must have a lawful basis to collect and process that data, provide accurate information to subscribers, honour unsubscribe and data-subject requests, and comply with applicable privacy laws (including GDPR where it applies). You must not use followtheduck to send unsolicited marketing without proper consent.

You agree not to: (a) use the service for spam, phishing, or illegal content; (b) attempt to bypass rate limits, security controls, or tier restrictions; (c) scrape, reverse engineer, or overload our infrastructure; (d) collect data you are not entitled to process; (e) impersonate others or misrepresent your affiliation; (f) resell or sublicense the service without permission. We may suspend or terminate accounts that violate these rules.

At launch, new waitlists are created on the free tier (3 free waitlists per account, view/export limits per waitlist as described on our website). Paid is €30 excl. VAT, a one-time purchase per waitlist, and will become available when checkout ships. Limits apply to owner dashboard visibility and export — public signup is not blocked when view limits are reached. We may adjust tier features with notice before billing is enabled.

The free tier is available at no charge. When paid tiers launch, fees will be displayed at checkout. All fees are exclusive of applicable taxes unless stated otherwise. Payments are non-refundable except where required by law.

followtheduck, its branding, software, and documentation are owned by OKQ or its licensors. You retain ownership of content you provide (waitlist names, descriptions, appearance settings). You grant us a limited licence to host and display that content solely to provide the service.

followtheduck is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant uninterrupted or error-free operation.

To the maximum extent permitted by applicable law, OKQ shall not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our total liability for any claim arising from these Terms or the service shall not exceed the greater of (a) amounts you paid us in the twelve months before the claim, or (b) €100. Nothing in these Terms limits liability where exclusion is prohibited by law.

You may stop using followtheduck at any time. We may suspend or terminate your account if you breach these Terms or if required for legal or security reasons. Upon termination, your right to access the service ends. Provisions that by nature should survive (liability limits, governing law) remain in effect.

These Terms are governed by the laws of Belgium, without regard to conflict-of-law principles. Disputes shall be submitted to the competent courts of Belgium, unless mandatory consumer protection rules in your country require otherwise.

We may update these Terms. We will post the revised version on followtheduck.app and update the "Last updated" date. Material changes may be communicated by email or in-app notice where appropriate. Continued use after changes constitutes acceptance where permitted by law.
